• Maintain and promptly update your account information to keep it accurate and current
• Keep your password and login credentials strictly confidential
• Notify us immediately at support@mhsgold.com of any unauthorised access or security breach of your account
• Accept full responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or are involved in suspicious activity.

Pricing & Payment

• All prices displayed on our website are in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless stated otherwise
• Gold prices fluctuate with international spot markets and are updated regularly; the price at the time of your confirmed order applies
• Payment must be made in full before any order is processed or gold is released
• Accepted payment methods include online bank transfer (FPX), credit/debit card, and cash at designated branches
• We reserve the right to cancel any order if payment is not received within the stipulated timeframe
• Transaction fees, delivery charges, or storage fees (where applicable) will be disclosed before checkout

Gold Investment Risks

• Gold prices can be volatile and are influenced by global economic conditions, currency fluctuations, geopolitical events, and supply and demand factors
• The value of your gold investment may decrease as well as increase
• MHS Gold does not provide financial, investment, tax, or legal advice
• Any information on our website is for general informational purposes only and does not constitute a recommendation to buy or sell gold
• You should consult an independent financial adviser before making any investment decisions
• Physical gold cannot be easily liquidated compared to other financial instruments; liquidity risk should be considered

Prohibited Conduct

You agree not to engage in any of the following activities:

• Using our platform for money laundering, terrorist financing, or any other illegal purpose
• Providing false, misleading, or fraudulent information during registration or transactions
• Attempting to gain unauthorised access to any part of our website or systems
• Circumventing, disabling, or interfering with security-related features of our website
• Scraping, data mining, or extracting data from our website without written permission
• Using our trademarks, logos, or branding without prior written consent from MHS Gold
• Engaging in any conduct that is defamatory, offensive, or harmful to MHS Gold or other users
• Reverse engineering or attempting to extract source code from our software

Violation of these prohibitions may result in immediate account suspension, legal action, and reporting to relevant Malaysian authorities including PDRM and BNM.

Intellectual Property

All content on this website including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software is the property of MHS Gold Trading or its content suppliers and is protected under Malaysian copyright law and international intellectual property conventions.

You are granted a limited, non-exclusive, non-transferable licence to access and use this website for personal, non-commercial purposes only. You may not reproduce, distribute, modify, display, perform, or create derivative works from any content without our prior written consent.

Limitation of Liability

To the maximum extent permitted by applicable Malaysian law, MHS Gold Trading, its directors, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Losses arising from gold price fluctuations or market volatility
• Service interruptions, website downtime, or technical failures
• Unauthorised access to or alteration of your data
• Errors or omissions in website content or pricing information

Our total liability to you for any claim arising from your use of our services shall not exceed the amount paid by you in the three months preceding the claim.

Termination

We reserve the right to suspend or terminate your account and access to our services at our sole discretion, without notice, for any reason, including but not limited to:

• Breach of any provision of these Terms
• Conduct that we believe is harmful to MHS Gold, other users, or third parties
• Requests by law enforcement or government authorities
• Extended periods of account inactivity

Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination shall continue to apply, including intellectual property rights, disclaimers, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

For consumer disputes, you may also refer to the Tribunal for Consumer Claims Malaysia (Tribunal Tuntutan Pengguna Malaysia) for claims below RM 50,000.
